11.2 Good-faith negotiation. The parties will attempt in good faith to resolve the dispute by negotiation within 21 days of the notice.
11.3 Mediation. If the dispute is not resolved by negotiation, either party may refer it to mediation administered by, or by a mediator appointed by, the Dispute Settlement Centre of Victoria. The mediation will be held in Victoria, Australia, and each party will bear its own costs and half the mediator's costs unless otherwise agreed.
11.4 Nothing in this clause prevents a party from seeking urgent injunctive relief, or affects your rights to complain to a regulator (including Consumer Affairs Victoria or the OAIC).
12. Termination
These Terms apply while you use this website. Clauses 5, 6.2, 8, 9, 10, 11 and 13 survive termination of your access.
13. Governing law, venue and general
13.1 These Terms are governed by the laws of Victoria, Australia, without reference to conflict-of-law principles. The services offered via this website are intended primarily for residents of Australia; if you access the website from elsewhere, you are responsible for compliance with local laws to the extent they apply.
13.2 Subject to clause 11, the parties submit to the exclusive jurisdiction of the courts of Victoria, Australia (and courts of appeal from them) for any dispute arising out of or relating to these Terms or this website.
13.3 If any provision of these Terms is invalid or unenforceable, it is severed and the remaining provisions continue in force.
